Terms & Conditions

We are NK Holidays Ltd (“NK Holidays.” “we,” or “us”, with company number 12726355 and a registered address at 3 Central Avenue, Sittingbourne, Kent ME10 4BX United Kingdom. These terms and conditions govern the contract between you and us regarding your Booking and your Holiday or Day Excursion.

DEFINITIONS

“Accommodation” means the accommodation provided to you by us as a part of the Holiday

“Booking” means the booking as made by you to attend one of our Holidays or Day Excursions in accordance with these Terms

“Day Excursions” means trips lasting 12 hours or less.

"Holiday" Means any holiday, activity or function organised or advertised by us.

"You" Means the person who has signed the Booking form and includes all the people on whose behalf you have signed.

"Supplier" Means the company or person that is holding or providing the event, accommodation or any part of the Holiday or Day Excursion

"Price" Means the total cost of the Holiday or Day Excursion including any additional events, trips, food or additional purchases you have made with us as a part of your Booking.

“Purchaser” Means the person who is acting as the lead name on the Booking form.

“Website” means the NK Holidays Website, which can be found at the address: https://nkholidays.co.uk

1. Terms and Conditions

1.1 These terms and conditions, including our respective policies as available on our Website, govern the contract between you and us. They will be incorporated into your Booking when you sign the Booking form.

1.2 We are unable to accept Bookings from anyone under the age of 16.

1.3 We reserve the right to ask you for proof of identification and for your name, address and contact details in order for us to process your Booking and payment.

2. Formation of Contract

2.1 No contract shall arise between you and us until we have received the deposit payable and we have sent to you written confirmation (This can be in the form of an email) of our acceptance of your Booking.

3. Alterations to your Booking

3.1 Your Booking shall be in accordance with the details confirmed at the time of Booking.

3.2 Your Booking shall be non-transferable and non-alterable within 30 days of your Holiday or Day Excursion start date. You may make alterations to your Booking until 30 days before your Holiday or Day Excursion start date subject to availability and payment of a non-refundable administration fee and any outstanding difference in Price. If you wish us to make an alteration to your Booking, we will use reasonable endeavours to accommodate your request but no guarantee can be given.

4. Purchaser

4.1 The Purchaser of any Booking with us accepts the full responsibility of collecting the full balance payable for the Booking and indemnifies “NK Holidays” against any loss from any individual failing to pay within your group. The Purchaser is responsible for ensuring that all group members are aware they are bound by our terms and conditions. It is understood that those Booking via email or telephone agree to, and accept our terms and conditions.

5. Payment & Deposits

5.1 A payment of not less than £50 per person is required as a non-refundable deposit (“Deposit”) at the time of Booking. The final balance is to be paid no less than 56 days (eight weeks) before the date upon which your Holiday is due to start. If payment has not been made in full by this time, we will assume that your Holiday has been cancelled and may resell the Holiday to another guest. Any Deposit or portion of the Price paid up to this point will not be refunded. Deposits are used by us to enter into the contractual arrangements on your behalf.

5.2 Payment for all Day Excursions must be given in full at time of Booking.

5.3 Payments can be made with a valid credit card or debit card, online bank transfers or cheque(s) made payable to “NK Holidays.”

5.4 Although we will endeavour to place the Booking for you at the same Price, we cannot guarantee that the Prices we show on our Website or quote to you verbally or in writing are accurate, and we shall not be liable to you for any errors or inaccuracies in the Price shown on the Website. We will however use all reasonable endeavours to notify you should there be an increase in the Price.

5.5 If a promised cheque is not received or does not clear upon presentation, we hold the right to cancel the reservation. Non-clearing or returned unpaid cheque will incur a £30.00 transaction charge.

5.6 All Prices are inclusive of VAT at the prevailing rate at the time of payment.

6. Cancellation by Us

6.1 We reserve the unconditional right to refuse a Booking or in the event of unreasonable conduct likely to cause distress, damage or annoyance to other passengers, employees, property or any third party, require you to leave the Holiday or Day Excursion. Should this situation occur our responsibility to you will cease at that point and we shall have no obligation to give you a refund.

6.2 Our Holidays have minimum passenger requirements. If we do not meet the minimum passenger requirements for the Holiday that you have booked, we will, at our sole discretion, make a refund to you of the cost paid to us of the Holiday or offer you a suitable alternative. We will not however, cancel your Holiday during the 42 days immediately prior to the departure date unless:
(b) You have not paid your Holiday in full.
(c) Your Holiday is influenced by events beyond our control such as war or threat of war, riots, civil strife, industrial action, natural disasters, fire, epidemics, bad weather, technical problems to transport, terrorist activities, hotel ceases trading, Governmental action or General Election or similar events beyond our control. Save as above we shall be under no further liability to you for cancellation of the event or any part of it.

7. Cancellation by You.

7.1 You may cancel your Booking within a period of 14 Days after the initial deposit, in which case we shall return your deposit to you in full. After 14 Days you may cancel your Booking; however, all deposits and (if applicable) any additional payments made to date on the Booking are non-refundable. All cancellations must be made in writing by the Purchaser. Your cancellation will take effect from the date when we receive written confirmation of your cancellation.

7.2 If you cancel your Booking between 56-42 days before the start date of your Holiday, we shall be entitled to charge you a cancellation fee of 25% of the total Price. If you cancel your Booking less than 42 days before the start date of your Holiday, including if you decide to end your Holiday early after it has commenced, we shall not be obliged to refund you any amount of the Price, and shall be entitled to retain 100% of the Price as a cancellation charge. Cancellation charges shall be retained from any refund you are entitled to if your Holiday is cancelled by you.

7.3 There will be no refund if you notify us of your intention to cancel your Day Excursion less than the 35 days before the date of the Day Excursion. If you inform us of your cancellation between 36-49 days before the date of the Day Excursion we will refund you 25% of the Price, if you inform us of your cancellation between 50 to 70 days before the date of the Day Excursion, we will refund you 50% of the Price, and if you inform us more than 71 days prior to the Day Excursion, we will refund you 75% of the Price.

8. Failure to Provide a Holiday.

8.1 if at our discretion, we decide that your Holiday or Day Excursion is unable to take place due to events beyond our reasonable control, we will provide you and your group with an alternative Holiday or Day Excursion. If this is not possible, we will provide you with a refund or the cost paid to us of the Holiday or Day Excursion. If you Holiday or Day Excursion is cancelled by us, we will use all reasonable endeavours to inform you of this cancellation as soon as reasonably possible

9. Accommodation and Meals

9.1 Your Holiday Price includes all coach travel, hotel Accommodation and meals, as specified in the Holiday description or itinerary. We will endeavour to meet any specialist dietary requirements, but we cannot guarantee that we will be able to. We accept no liability if our Suppliers are unable to meet these requests.

9.2 You must ensure that you check in at your Accommodation and attend the meals at the times specified to you by us or the Supplier. You must ensure that you comply with all of our and the Supplier’s reasonable instructions when you are in the Accommodation.

10. Excursions & Admissions

10.1 Unless specifically indicated in the Holiday or Day Excursion description, entrance fees, guide fees, city guided tours and optional excursions are not included in the Price, and will be subject to additional charges.

11. Personal Data.

11.1 The information you give us in connection with your Booking is held securely on our computer system and dealt with in accordance with the Data Protection Act 2018.

11.2 By providing us with this information you are deemed to accept this and to have the consent of all members of your party to this. We keep this information to help us improve our service to you and to provide you with information about our Holidays, Day Excursions and services by telephone, e-mail, post and SMS and to keep you informed of our latest news and offers.

12. Alterations + Surcharges Applied By Us

12.1 If due to circumstances beyond our control it becomes necessary to substitute an alternative Supplier, or make any other alterations to the Holiday or Day Excursion (including Accommodation) we shall inform you of the changes as soon as possible. If the changes are, in the view of “NK Holidays” so substantial as to materially alter the Holiday or Day Excursion and you are unwilling to accept them then you may cancel the Holiday or Day Excursion and we will give you a refund of the cost paid to us of the Holiday or Day Excursion.

13. Alterations made by You

13.1 We shall try to accommodate any reasonable changes you wish to make to the Holiday or Day Excursion. Alterations and amendment requests should be made with us and not end Suppliers and should be made in writing to us by the Purchaser. These changes shall not be deemed accepted until we have confirmed in writing to you. I

13.2 if you wish to increase or decrease the number of persons participating in the Holiday you may do this up to 56 days prior to the date upon which your Holiday is due to start. Amendments after that date may incur our administration charge of £10.00 per person. Subject to our written agreement you may transfer your Booking to a person who satisfies all the conditions applicable to the Holiday.

14. Disabled & Special Needs.

14.1 Some of our Holidays and Day Excursions offer specific Accommodation suitable for Holidaymakers with wheelchairs or who may have mobility difficulties. However certain Accommodations and locations may not be suitable, and we will advise you of such if we are aware that you suffer from a disability that may mean these locations will not be suitable.

14.2 If your party includes someone with specific requirement it is your responsibility to advise our staff if you have a disability at the time of Booking and any special requests you may have for travel or Accommodation. Please note we will take fold up wheelchairs and walking aids provided this has been requested at the time of Booking due to limited space, so please book early to reserve this space. Electric wheelchairs & scooters will be allowed provided they are lightweight and can be folded up, we do not guarantee loading onto the coach if our staff are unable to load them safely.

14.3 PLEASE NOTE: If we have not been advised of wheelchairs, walking aids etc, or they have not been booked we have the right to refuse to carry them.

15. Your Obligations

15.1 You shall at all times behave in a safe, responsible and courteous manner; comply with all instructions; regulations and codes of practice issued by us or our Suppliers; ensure that you comply with all age restrictions imposed by our Suppliers; ensure that you comply with all arrival times, and dress appropriately for the Holiday or Day Excursion.

15.2 You should be at the correct pick up point at the time specified on your ticket. No refunds will be given if you miss the coach because of lateness. All seats are allocated at the time of Booking should you have requests for specific seats we will do our best to honour them on a first come first served basis.

15.3 If you breach these obligations we may cancel or curtail the Holiday or Day Excursion or any part of it and in those circumstances, you shall not be entitled to any refund. You shall take out insurance suitable for your needs (including delays for events involving travel by land, sea, or air) before the event.

16. Standard of behaviour

16.1 Our Holidays and Day Excursions may be attended by families and we would ask that the behaviour of you and your party reflects this fact. Noisy, offensive or inappropriate behaviour or actions likely to cause harm to any other guest, members of our staff and will not be tolerated. No refunds will be issued in these circumstances.

16.2 If, in the reasonable opinion of the management of the park, we believe that you or a member of your party may not comply with the above, we reserve the right to refuse your entry to the Holiday or Day Excursion to any person or groups of persons at our discretion. In such cases a full refund will be issued to the Purchaser on the Booking.

16.3 All children must be properly supervised by their parents or guardians throughout your Holiday or Day Excursion, including all organised activities and travel.

16.4 NK Holidays and our Suppliers will not tolerate physical or verbal abuse towards our staff. We have a zero-tolerance policy and you may be asked to leave the Accommodation immediately. In these cases, no refunds will be offered.

17. Pets.

17.1 We do not permit you to bring pets with you on any of our Holidays or Day Excursions, with the exception of assistance dogs for disabled guests. If you are planning to bring an assistance dog with you on your Holiday or Day Excursion, you must give us reasonable notice. Assistance dogs must be kept on a lead at all times and you must clean up after your pet and follow any instructions as given to you by the Supplier.

17.2 Assistance dogs must not be left unattended at any time and must not be allowed on any beds or seating in the Accommodation. You shall be liable for any damage caused by your assistance dog to the Accommodation or any vehicles or property belonging to us in the duration of the Holiday or Day Excursion.

18. Our Obligations

18.1 We shall take reasonable care and skill in arranging the Holiday or Day Excursion and comply with all applicable laws in relation to the Holiday or Day Excursion; wherever possible, re-schedule the Holiday or Day Excursion instead of cancelling or offer a refund to you of the cost to us of the Holiday or Day Excursion. All the photographs and illustrations we use on our Website and in literature (including quotations) we send you are for marketing purposes and may not entirely represent the actual products received.

19. Availability of Facilities

For health and safety reasons, some of the Holiday or Day Excursion facilities and activities may have age and/or height restrictions. Please check these with us when you book your Holiday or Day Excursion. At busy times we or the Supplier may restrict access to the facilities at our discretion. We shall have no liability to you for your inability to use the facilities due to such restrictions.

20. Entertainment

We will endeavour to provide you with the entertainment as advertised on our Website and otherwise communicated to you; however, at selected Accommodations and during certain periods of the year, entertainment may be limited. We reserve the right to alter or withdraw any facilities or programmed entertainment without prior notice.

21. Marketing accuracy

Whilst every care is taken to ensure that the details on our Website are correct at the time of being published, the images shown are for illustration purposes only and the details may be subject to alteration from one Holiday or Day Excursion to another.

22. Customer Feedback

Should you have a problem whilst on your Holiday or Day Excursion then you must contact the appropriate person(s) at the earliest opportunity, for example Accommodation / restaurant manager. Unless there is a valid reason why you did not report your problem to the appropriate person(s), we will not consider ourselves liable for those complaints. If they are unable to resolve matters to your satisfaction then you must write to us within 7 days of the conclusion of the Holiday or Day Excursion at 3 Central Avenue, Sittingbourne, Kent ME10 4BX United Kingdom. All complaints should be from the Purchaser and contain your Booking reference number. No complaint will be accepted outside of this time frame thus deeming you fully satisfied with all aspects of the Holiday or Day Excursion and the services we have provided to you. We will acknowledge any correspondence within 5 working days and endeavour to deal with the complaint as quickly as possible.

23. Liability

23.1 Our liability to you shall not exceed the total Price paid by you to us under these Terms and Conditions.

23.2 Nothing in these Terms and Conditions should be construed as an attempt to limit or exclude any liability that cannot legally be limited, including wilful fraud and death or personal injury resulting from negligence.

24. Contracts (Rights of Third Parties) Act 1999

24.1 No part of this agreement shall confer on any third party any benefit or right to enforce any terms of this agreement.

25. Entire Agreement

25.1 These Terms and Conditions are the entire agreement between you and us on the subject matter.

26. Jurisdiction

26.1 This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our Suppliers.

27. No Waiver.

27.1 No waiver by either party of any right or remedy under these Terms and Conditions shall be effective unless delivered in signed writing to the other party. No failure or delay by either party to exercise any right under this agreement shall be construed as a waiver and no waiver of any right or remedy under these Terms and Conditions shall constitute a waiver of any subsequent breach.

28. Severance

28.1 If any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement.

29. Changes to these Terms and Conditions

29.1 We may need to make changes to these terms and conditions. Any changes can only be made by us and not any third-party member. We reserve the right to amend or improve these terms and conditions without prior notification.

29.2 When it is necessary for us to make changes to these terms and conditions we will use all reasonable endeavours to give you reasonable notice of such change; however, you are responsible for ensuring that you familiarise yourself with the content of these terms and conditions, and for ensuring that you regularly check our website for updates to these terms and conditions.

1.1 We try to ensure that access to this website is uninterrupted and error free. However, due to the nature of the internet the website is provided on an "as available" basis. We will not be liable if for any reason the website is unavailable at any time for any period. We will not be liable for loss or damage arising if this website becomes unavailable or is suspended for any reason.

1.2 Unless otherwise stated, the rights in the designs, pictures, logos, photographs, documentation, information and other content of this website are owned by or licensed to us. They are protected by copyright, trademarks and other intellectual property rights.
